S-cool Student Agreement & Terms of Service

1. Definitions
To ensure clarity, the following terms are defined as:
- “Subscriber”: The parent or legal guardian who registers and pays for the service.
- “Student”: The minor or individual attending the classes.
- “Delivered Class”: A scheduled session where the instructor was present and available to teach, regardless of student attendance.
- “Listener Mode”: Participation in a live class with the microphone muted due to lateness.
- “Unjustified Absence”: An absence without the required prior notice (4 hours) or a verifiable emergency.
- “Standard Pre-Recorded Lesson”: A generic, pre-recorded instructional video covering the core topic of the missed session (not a personalized recording).
2. Acceptance, Parental Consent & Account Security
- Legal Agreement: By enrolling in S-cool, the Subscriber agrees to these Terms of Service.
- Minors: You verify that you are the legal parent or guardian of the Student. You authorize the Student to participate and accept full responsibility for their conduct.
- Account Security: Subscribers are responsible for maintaining the confidentiality of their login credentials. Any activity that occurs under your account is your responsibility.
- No Guarantee of Results: S-cool provides professional instruction and tools; however, we do not guarantee specific grades, levels of mastery, or future employment outcomes.
- Group Composition: S-cool reserves the right to merge groups or adjust schedules with reasonable notice (typically 24–72 hours).
3. Student Rights
Every Student has the right to:
- A Safe Environment: To learn free from bullying, harassment, or discrimination.
- Ownership: To retain 100% intellectual property rights over their own creations and code.
- Quality Instruction: To receive professional guidance during scheduled hours.
- Privacy: To have their personal data and image treated with confidentiality and security.
4. The “Focus First” Protocol (Cameras & Privacy)
- Identity Verification: Cameras are mandatory during the first 3-5 minutes for ID verification.
- Screens First: Once instruction begins, cameras may be turned off to prioritize bandwidth.
- Safe Environment: Students must use a neutral background or “Blur” effect.
- Data Protection: S-cool records sessions for safety/quality using industry-standard security. Students are strictly prohibited from recording or distributing session content.
5. Attendance, Punctuality & Absence Types
- The 10-Minute Rule: Classes start on time. Late arrivals (>10 mins) enter in “Listener Mode”. This counts as a Delivered Class.
- Rescheduling: Cancellations must be made at least 4 hours in advance to qualify for rescheduling.
- No-Show Policy: Missing a class without notice is considered a “Delivered Class” deducted from the plan.
- Group Sessions: The class proceeds with present students. Absent students receive the session recording.
- Total Group Absence: If no students attend, the instructor waits 15 minutes. The session is closed and counts as a Delivered Class. Students receive a Standard Pre-Recorded Lesson.
- Individual Sessions: Instructor waits 15 minutes. If the student does not arrive, the session ends. The student receives a Standard Pre-Recorded Lesson.
6. Absences & Automated Notifications
- 1st & 2nd Unjustified Absence: An automated notification will be sent to the Subscriber.
- 3rd Unjustified Consecutive Absence: We will initiate a personal check-in with the Subscriber.
- 4th Unjustified Consecutive Absence: The subscription will be paused, and the Student’s reserved spot in the group will be released to the waitlist.
7. Code of Conduct & Prohibited Behavior
- Zero Tolerance: Bullying/Hate Speech = Immediate Expulsion (No Refund).
- Prohibited Behaviors: Sharing passwords, harassment, using unauthorized AI tools, bypassing security.
- Parental Interference: Parents generally may not interrupt live instruction.
- Communication: All communication must be via official platforms (Discord/Web). Private messaging (WhatsApp/DM) is prohibited.
8. Technology Requirements & Failures
- Hardware: Subscriber confirms possession of required PC/Mac & 3-Button Mouse.
- Student Technical Failure: S-cool is not responsible for learning interruptions caused by the Student’s local internet instability or inadequate hardware. No refunds/make-ups are issued for these cases.
- Instructor Technical Failure: If a session is interrupted due to a technical failure on the Instructor’s side (excluding Force Majeure), the class will be fully compensated via a replacement lesson or extension at no additional cost.
9. Intellectual Property & Data Retention
- Student Work: The Student retains 100% ownership of their creations.
- S-cool Materials: Teaching materials are for personal use only. Redistribution is prohibited.
- Recording Access: Students may access their session recordings for up to 12 months after the conclusion of the course (final class date). After this period, data may be archived or deleted.
10. Billing, Membership & Cancellation
- Single User Policy: One student per membership. No account sharing.
- Payment Methods: We accept Credit/Debit Cards (via Stripe) and PayPal.
- Authorization: The Subscriber authorizes recurring monthly charges.
- Payment Failures: If payment fails, access is paused immediately until renewed.
- Cancellation: Cancel anytime via Dashboard. Stops future billing. No partial refunds.
- Termination by S-cool: S-cool may terminate access for violations. No refunds for misconduct.
- Refund Policy: Refunds are issued only if S-cool fails to provide the Service (no class, no substitute, no reschedule).
- Pre-Paid Courses & Bundles:
- Full Course Payment: Students who opt to pay for a full course upfront receive a discounted rate. Because of this discount, pre-paid fees are non-refundable after the first 14 days of the course start date.
- Bundles: If a student cancels one course within a bundle, the remaining courses will be re-billed at the standard individual monthly rate.
11. Support, Disputes & Chargebacks
- Response Time: Support replies within 24–48 hours (business days).
- Chargeback Policy: Filing a chargeback for a Delivered Class/No-Show is a breach of contract. Account/Materials access will be terminated.
12. Force Majeure, Liability & Jurisdiction
- Force Majeure: Not liable for events beyond control (natural disasters, massive ISP outages).
- Limitation: Liability limited to the amount paid for the current billing cycle.
- Governing Law: Laws of Mexico. Disputes resolved exclusively in Aguascalientes, Mexico.
13. General Provisions
- Severability: If any provision is unenforceable, the rest remain in effect.
- Entire Agreement: These Terms constitute the entire agreement.
